Spats was one of five thugs who attacked Falcon - and tried to kill him - in the opening five pages of Captain America (vol. 1) #169. Spats was working for the Harlem-based crimeboss known as Boss Morgan.
At first these thugs tried to run the Falcon over while he was walking. The Falcon was able to move out of the way enough that he didn't bear the full brunt of the impact. Then the thugs got out of the vehicle and tried to beat Falcon up, telling him that if he refused to join Morgan's gang, then Morgan wanted him dead.
Spats' name was specifically identified in panel 3 on page 3 of this issue. A fellow thug (Bim?) said (while punching the Falcon): "Keep pourin' it on, Spats! The Falc's made it plain he ain't joinin' Morgan's mob-- so he ain't gettin' a chance to move against it!"
