An unnamed store clerk was attacked by the super-villain known as the Tumbler (John Robert Keane) in a plot to discredit Captain America.
On page 11 in Captain America (vol. 1) #169, Captain America has just left a meeting with advertising executive Quentin Harderman, the man running an anti-Captain America advertising campaign. Back on the New York City streets, Cap hears a cry for help coming from a nearby liquor store named "Spirits Shop." Captain America rushes into the store and sees an unnamed store clerk lying unconscious on the floor. The Tumbler, a costumed criminal Cap has faced before, is fleeing the scene.
The Tumbler thinks to himself: "The boss must be nuts! The bread from this haul doesn't even match my fee! Still, he claims this set-up will help discredit Captain America-- and I'm all in favor of that!"
So the Tumbler only robbed the liquor store because he was following somebody else's orders. The person who arranged the robbery was actually Quentin Harderman, who wanted to arrange for a confrontation between the Tumbler and Captain America (but Cap didn't know this).
Captain America goes to an auto exhibit Quentin Harderman invited him to (on the promise of suspending the anti-Cap ad campaign if he went and performed in a charity boxing exhibition). At the exhibit, Captain America recognizes the Tumbler in his civilian identity. Cap tries to apprehend the Tumbler, only to see him die suddenly! The Tumbler was secretly killed by Moonstone (Lloyd Bloch), who made it look like Cap killed him.
In the next issue (#170), people who witnessed the scene are accusing Captain America of being a murderer. Captain America protests: "Now wait! This guy's the Tumbler, who just banged up a store clerk into the hospital! And I didn't hit him that hard--"
